Acuerdos extrajudiciales con bancos extranjeros
La danza de los millones
Juan Luis Cebrián, uno de los periodistas iberoamericanos que más respeto y presidente del diario El País, apuntó que el periodismo tiene un enorme futuro --¿comercial o de contenidos o las noticias virtuales?--, pero hay que reinventarlo. Y tiene toda la razón. Para mí, Cebrián se refiere al reto que tienen y tendrán que afrontar las nuevas generaciones de jóvenes periodistas.
Con este sencillo pero práctico mensaje, Cebrián cerró el homenaje que le organizaron por su trayectoria los amigos de la Cátedra Alfonso Reyes, del Instituto Tecnológico de Estudios Superiores de Monterrey. El evento tuvo lugar en el campus ante una audiencia formada (en su mayor parte) por estudiantes de periodismo. También se sumaron a la conferencia: Antonio Caño, la filósofa Amelia Valcárcel, y el escritor Julio Ortega. Otro colega de la prensa, Aurelio Collado, la hizo de moderador.

Lo que faltaba en los acuerdos era alguna mención a la responsabilidad penal. Eso contrastaba con los acuerdos extrajudiciales con bancos extranjeros como Credit Suisse y BNP Paribas. Que fueron obligados a admitir su culpa por violación de sanciones y evasión fiscal, respectivamente. Es más, a ningún directivo de primer nivel se le pidió cuentas. Incluso la promocionada campaña contra las operaciones bursátiles con información privilegiada resultó decepcionante. Pese a algunas condenas, parece que la impresión general sobre Wall Street pescó morralla y dejó ir a los “peces gordos” (como es habitual ya casi en todo el orbe, para políticos, empresarios y artistas; bueno, ¡no todos!). No toda la culpa la tuvo el fiscal general, pero constaté que con la operación Rápido y furioso también salió ¡airoso!
Las pruebas que se requieren para imponer condenas penales son contundentes, y demostrar que los altos directivos cometieron irregularidades es difícil en el menor de los casos. Y otro ejemplo. Vemos continuamente como el gobierno de Estados Unidos exonera a criminales/narcos que se dedican al narcotráfico con la condición que revelen sus fuentes, pistas, laboratorios, socios y cómo lavan dinero sus “compinches”. Sí, ¡el mundo al re—vés!
Por otro lado, otra de Holder: él mismo se hizo un flaco favor: by example (¡por ejemplo!): al informar al Congreso que “puede ser difícil juzgar a los grandes bancos, porque al hacerlo, ¡se puede perjudicar la economía o bien decir que se perjudica a millones de cuentahabientes. Sus sucesores harían bien en recordar que castigar las irregularidades financieras no debería consistir solo “en la imposición de multas”.
La catástrofe de 2008
Holder llegaba tarde cuando al fin hizo chasquear el látigo, hace un par de años. Los plazos de cinco años para iniciar los juicios penales relacionados con la catástrofe de 2008 estaba a punto de prescribir, y todo lo que el Departamento de Justicia tenía realmente para enseñar era un ramillete de condenas por operaciones bursátiles con información privilegiada. Sé que los fiscales desempolvaron una dey de 1989 para el desastre de las cajas de ahorros, al darse cuenta de que su plazo de descripción de 10 años y su escasa rigurosidad en la carga de la prueba ayudarán –sin duda alguna-- “a recuperar el tiempo perdido”.
A continuación se produjeron unos acuerdos llamativos: 7.000 millones de dólares de Citigroup, 13.000 millones de JP Morgan y, el hace dos meses, 16.500 millones de Bank of America. Sí, la danza de los millones. Y de dónde sale este dinero: ¡de la bolsa de los cuentahabientes y después pregonan que el mundo entrará en nuevas crisis mundiales de dinero! Y hasta la próxima, ¡abur!
